Facts
The United States government (plaintiff) prosecuted Michael O’Keefe and Sunil Agrawal (defendants) for bribery. O’Keefe and Agrawal filed a motion to compel the government’s compliance with the federal court’s electronic-discovery (e-discovery) order. The two men suggested that the government’s search protocols were inadequate to fulfill the order’s directive to produce all relevant electronically stored information (ESI) in the government’s possession.
