Facts
The United States (plaintiff) brought a forfeiture action alleging that Suarez, Inc. (defendant) violated § 11 of the Endangered Species Act (ESA) by importing 55 handbags and 2 belts (the goods) made from yacare, an endangered subspecies of crocodile. Suarez argued that the forfeiture proceeding violated the Fifth Amendment Due Process Clause because only a limited number of experts are able to distinguish yacare from other subspecies of crocodile that share the yacare’s physical characteristics. Additionally, Suarez argued a good-faith defense to the forfeiture, claiming to be an innocent purchaser unaware that the goods violated the ESA.
