Facts
Arthur Payton (defendant) serially robbed banks, usually with the help of a specially recruited female accomplice. Payton was caught, tried, and sentenced on three occasions—first in his 20s, then in his 30s, and finally at age 46. The federal sentencing guidelines’ recommended range was 17.5 to 22 years. However, citing Payton’s recidivism, the district judge sentenced him to 45 years in prison. Payton appealed, arguing that the sentence was unreasonable. The United States Court of Appeals for the Sixth Circuit granted certiorari.
