- Written by Sean Carroll, JD
Facts
Quality Egg, LLC (defendant) produced eggs with salmonella that made thousands of people sick. Austin DeCoster (defendant) owned Quality Egg, and his son Peter DeCoster (defendant) helped to run the company. The DeCosters were each individually charged with and found guilty of a crime under the Food, Drug, and Cosmetic Act (FDCA). The district court sentenced the DeCosters to one year in prison, the statutory maximum under the FDCA. The DeCosters appealed, arguing that the sentencing was unconstitutional.
