Facts
Gilberto Ray Ramos (defendant), a convicted felon, was being investigated by police for selling methamphetamine. On December 5, 2014, police searched Ramos’s apartment, which Ramos shared with Jasmyn Schmidt. The police found a gun hidden in a bedroom that contained women’s clothing and other items indicating a woman slept there. Ramos was charged with and convicted of constructively possessing a firearm in violation of 18 U.S.C. § 922(g)(1), which prohibited a person previously convicted of a felony from possessing a firearm. Ramos appealed, arguing that there was insufficient evidence linking him to the firearm.
