Facts
Brian Robinson (defendant) was convicted of producing, distributing, and possessing child pornography. A pre-sentencing report calculated a 720-month sentence for Robinson under the United States Sentencing Guidelines (the guidelines). At sentencing, Robinson requested that the district court consider his prior cooperation with investigators in two other cases pursuant to 18 U.S.C. § 3553(a). Noting that the prosecution had not requested a departure from the guidelines sentence pursuant to U.S.S.G. § 5K1.1, the district court ruled that it did not have the power to consider Robinson’s prior cooperation. Robinson was sentenced to 720 months’ imprisonment. Robinson appealed.
