Facts
At the court-martial of Army Specialist Hector Rodriguez (defendant), the military judge found that the psychotherapist-patient privilege did not apply in military trials. Rodriguez was convicted. On appeal, Rodriguez challenged the military judge’s ruling on the privilege issue.
