Facts
A dispute arose between Roll Coater, Inc. (Roll Coater) (defendant) and the United States Environmental Protection Agency (EPA) (plaintiff). Roll Coater engaged in the coil-coating manufacturing process. As a result of Roll Coater’s manufacturing process, the EPA asserted that Roll Coater emitted unsatisfactorily treated effluent into a wastewater system. Roll Coater had numerous violations of the Clean Water Act, but there were no proven damages. Roll Coater made good-faith interim improvements to the existing facility and built a treatment facility that utilized the latest technology. The EPA brought an action against Roll Coater under the Clean Water Act and the National Categorical Pretreatment Standards promulgated under the act.
