Facts
Samir Sain and his company Advanced Environmental Consultants, Inc. (AEC) (defendants) had a contract with the United States Army to construct and operate a wastewater treatment plant. The Army increased the water purity standard, resulting in higher operating costs. To obtain reimbursement of the increased costs, AEC inflated the amount of the claims submitted to the Army. The level of pollutants in the water and the quantity and grade of carbon used to purify the water were falsified and substantiated by fake checks and purchase orders. Sain and AEC were indicted for, and convicted of, multiple violations of the major-fraud statute. On appeal, Sain argued that he was improperly charged with committing a separate violation for each false claim submitted to the Army.
