Facts
Guillermo Novo Sampol, Alvin Ross, and Ignacio Novo (defendants) were charged with the murders of Ronni Moffitt and Orlando Letelier, the former Chilean ambassador to the United States. At trial, the prosecution (plaintiff) called Ricardo Canete as a witness. Defense counsel sought to introduce evidence regarding Canete’s adherence to the Luceme religion and specifically his consultation with the religion’s spirits prior to taking any action. The district court excluded the evidence based on Federal Rule of Evidence 610 (Rule 610). The defendants were convicted, and they appealed.
