Facts
Luis Santiago-Martinez (defendant) was convicted of felony drug charges. During jury selection, the defense counsel raised a Batson challenge, arguing that the prosecutor had violated equal protection by striking three venirepersons that the defense counsel perceived as obese. Although the defense counsel claimed that Santiago-Martinez was not obese, the defense counsel himself claimed to be obese. The district court rejected the Batson challenge, finding that the defense counsel and one of the relevant venirepersons were not obese. Santiago-Martinez renewed the Batson challenge in his appeal.
