Facts
Armando Santos (defendant) was tried for assaulting a federal officer. At trial, Santos sought to introduce as evidence an affidavit by a narcotics agent, Edward Dower, who had witnessed the assault. Dower’s affidavit named someone other than Santos as one of the three assailants. Santos sought to introduce the affidavit as an admission against the government. The trial court excluded the affidavit, and Santos was convicted by the jury. Santos appealed.
