Facts
The United States Department of Agriculture Food Safety and Inspection Service detected illegal levels of new animal drug residue in the edible tissues of cows sold by Scenic View Dairy, L.L.C. (defendant). The government sought to enjoin Scenic from violating the Food, Drug, and Cosmetic Act by selling the cows, which the government argued were adulterated food under the act. Specifically, the government stated that Scenic had used new animal drugs on the cows in a way not approved by the Food and Drug Administration (FDA). Scenic responded that its use of the new animal drugs was lawful because the use had been ordered by a veterinarian.
