United States v. Shelledy
United States Court of Appeals for the Eighth Circuit
961 F.3d 1014 (2020)
- Written by Sean Carroll, JD
Facts
Jackie Shelledy (defendant) was charged with various drug-related crimes. At trial, the prosecution (plaintiff) called Teresa Wolfe (defendant) as a witness. Wolfe had pled guilty to the charges and provided testimony implicating Shelledy. Shelledy sought to cross-examine Wolfe about Wolfe’s prior convictions that were more than 10 years old. The district court rejected the questioning pursuant to Federal Rule of Evidence 609(b) (Rule 609(b)). In addition, Shelledy sought to cross-examine other government witnesses about specifics regarding their prior convictions. The district court permitted Shelledy to inquire about these prior convictions to reveal their underlying offenses’ types, places, dates, and sentences but declined to permit Shelledy to inquire about additional details or specifics. Shelledy was convicted, and he appealed.
