Facts
Erick Smith (defendant) was charged with conspiracy to distribute and possess cocaine with intent to distribute. Smith pled not guilty. At trial, the prosecution (plaintiff) sought to admit Smith’s two prior cocaine-possession convictions into evidence. The district court admitted the convictions over Smith’s objection. Smith was convicted, and he appealed, arguing that the prior convictions should have been excluded under Federal Rule of Evidence 404(b) (Rule 404(b)).
