Facts
Francisco Toscanino (plaintiff), an Italian citizen, was convicted of conspiracy to import narcotics into the United States and was sentenced in New York. At trial, Toscanino denied any knowledge of drug transactions by coconspirator defendants. Toscanino appealed the conviction through a motion to vacate the judgment, requesting that he be allowed to return to his home in Uruguay. Toscanino argued that the court obtained personal jurisdiction through illegal electronic surveillance and through kidnapping him from his home in Uruguay via American agents, in violation of his constitutional rights and several international laws and treaties. The government (defendant) argued that Toscanino’s claims were irrelevant and that the court had jurisdiction. Toscanino’s motion to vacate was denied, and Toscanino appealed.
