Facts
Udeagu (defendant) was charged with importation of heroin and possession of heroin with intent to distribute. Udeagu pled guilty to one count of importation of heroin. Udeagu spoke on the record about his guilt during his plea allocution. Subsequently, however, Udeagu withdrew the plea on the ground that he was not actually guilty of the crime. Udeagu then filed a motion in limine asking the court to exclude evidence of the guilty plea and subsequent withdrawal, even for use in impeaching Udeagu’s credibility if he were to take the stand as a witness.
