Facts
The United States government accused Wilfried Van Cauwenberghe (defendant) of committing several fraud-related crimes. Van Cauwenberghe was arrested in Switzerland, and that country’s highest court approved Van Cauwenberghe’s extradition to face trial in the United States. Following the transfer, a federal district-court jury found Van Cauwenberghe guilty on all counts. On appeal to the Ninth Circuit, Van Cauwenberghe challenged his convictions for two specific fraud-related offenses that Van Cauwenberghe pointed out were not explicitly mentioned in the extradition treaty between Switzerland and the United States.
