Facts
The government charged George Varoudakis (defendant) for conspiring to commit arson after his nightclub burned. Varoudakis’s longtime girlfriend, Cheryl Britt, testified that Varoudakis burned a leased Cadillac 16 months beforehand. Britt said she was just along for the ride and did not participate in burning the car. A police officer testified about investigating a car fire that corroborated Britt’s testimony. The jury reached an impasse and took two and a half days to find Varoudakis guilty. Varoudakis appealed, arguing the court erred in admitting the car-fire evidence.
