Facts
Peter Vongxay (defendant) was arrested with a firearm in his possession. Vongxay had been previously convicted of three nonviolent felonies: one for possessing drugs and two for burglarizing cars. A federal law prohibited felons from possessing firearms, and Vongxay was charged with violating this law. Vongxay moved to dismiss the charges, arguing that the law was unconstitutional because it violated the Second Amendment. The district court denied Vongxay’s motion to dismiss, and Vongxay was ultimately convicted of violating the law. Vongxay appealed his conviction.
