Facts
Charles Walker (defendant) was indicted in federal district court on charges of distributing heroin, distributing fentanyl, and being a felon in possession of a firearm. Walker and the United States government (plaintiff) entered a plea agreement under which some charges would be dismissed and a traditional jury trial would be avoided. The choice of whether to accept or reject the plea bargain rested with the judge. The case occurred against a backdrop of the increasing use of heroin and synthetic opioids such as fentanyl—drugs with a particularly high risk of fatal overdose. West Virginia led the nation in overdose deaths caused by these drugs.
