Facts
Chip Ward (defendant) was the president of Concept Services Inc., a company that handled dangerous chemicals. An accident occurred during the handling of a chemical called hydroxylamine. Ward was criminally prosecuted for willfully violating an Occupational Safety and Health Act regulation against mishandling hydroxylamine at a certain concentration. The United States (plaintiff) argued that its interpretation made it clear that Ward’s actions were illegal. Ward contended that the statute was not clear.
