Facts
Robert Ware and four others (defendants) were indicted for conspiracy to distribute cocaine. Two coconspirators pleaded guilty and testified against Ware at trial. The two coconspirators’ plea agreements with the government permitted them to plead guilty to fewer counts than were charged in the indictment. Ware was convicted and argued on appeal that the government (plaintiff) violated the federal bribery statute, 18 U.S.C § 201(c), by offering something of value to a witness for or because of the witness’s testimony.
