Facts
Attorney Frank Swan was disqualified from representing William and Beverly Wunsch and their daughter Teri Sowers (defendants) in a criminal tax prosecution. After being disqualified, Swan sent the prosecutor a letter to which he attached a sheet of paper reading: “MALE LAWYERS PLAY BY THE RULES, DISCOVER TRUTH AND RESTORE ORDER. FEMALE LAWYERS ARE OUTSIDE THE LAW, CLOUD TRUTH AND DESTROY ORDER.” The district court sanctioned Swan pursuant to Local Rules of the Central District of California 2.5.1 and 2.5.2, § 6068(f) of California’s Business and Professions Code, and the court’s inherent power.
