Facts
Xulam (defendant) was a Kurdish citizen of Turkey who had resided for three years in the District of Columbia and advocated for Kurdish rights. Xulam was arrested by the Immigration and Naturalization Service for having used a false name on a passport application when he entered the United States from Canada on a student visa. The United States (plaintiff) moved the district court to keep Xulam under detention pending trial on the sole basis that he posed a flight risk. The United States conceded that Xulam posed no danger to the public. The district court granted an order for pretrial detention. Xulam appealed the district court order.
