Facts
The United States government indicted Ramzi Yousef and others (defendants) for conspiring to blow up United States commercial airliners. Count 19 of the indictment charged Yousef with detonating a bomb on board a Philippines airliner. Yousef challenged the federal district court’s jurisdiction over the Philippine incident and moved to dismiss Count 19.
