Facts
The United States (plaintiff) charged Humphrey (defendant) with illegal betting activities. As part of a warrant-authorized search of Humphrey’s house, government agents answered his phone several times and listened to people on the other line placing bets. The prosecution sought to introduce the evidence of these phone calls to show that the callers thought the house was used for betting activities. Humphrey objected on the ground that the phone calls were inadmissible hearsay.
