Facts
A New Hampshire statute gave state employees and nonacademic employees of the state university system the right to engage in collective bargaining. This statute did not provide academic employees of the state university system with these rights. The University of New Hampshire Chapter of the American Association of University Professors (AAUP) (plaintiff) petitioned Haselton, the Chairman of the State Personnel Commission, and other state officials (defendants) for the right to act as the exclusive bargaining representative for academic employees on the University of New Hampshire (UNH) campus. Haselton refused based on the state statute that excluded academic employees from the right to engage in collective bargaining. The AAUP filed a lawsuit, alleging that their rights under the First Amendment and the Equal Protection Clause had been violated.
