Yale Diagnostic Radiology v. Estate of Fountain
Connecticut Supreme Court
838 A.2d 179 (2004)

- Written by Rich Walter, JD
Facts
Yale Diagnostic Radiology (Yale) (plaintiff) billed 13-year-old Harun Fountain’s mother, Vernetta Turner-Tucker (defendant), for the emergency medical services Yale provided to save Fountain’s life after Fountain was shot in the head. Turner-Tucker either would not or could not pay the bill, so Yale petitioned for payment from an estate (defendant) established on Fountain’s behalf. The probate court’s denial of Yale’s petition was reversed on appeal by an intermediate appellate court. Turner-Tucker and the estate appealed to the Connecticut Supreme Court.
