Facts
Former employees and survivors of former employees (employees) (plaintiffs) sued PPG Industries, Inc. (PPG) and others (defendants) for injuries they suffered after being exposed to asbestos fibers during their employment at PPG’s asbestos plant in Tyler, Texas, between 1962 and 1972. The employees were exposed to asbestos fibers in varying amounts while they worked at different positions throughout the plant. In their petitions, the employees claimed that the exposure caused them to suffer asbestosis, lung cancer, or other pulmonary diseases, and they sought damages under different theories for relief against different defendants, including negligence, gross negligence, strict liability, and statutory workers’ compensation. The employees moved to proceed with the litigation as a class action under Federal Rule of Civil Procedure 23(b)(3) on the issue of liability.
