Facts
Yellow Cab Company of Sacramento (Sacramento) (plaintiff) sued Yellow Cab of Elk Grove, Inc. (Elk Grove) (defendant) for trademark infringement. The district court entered summary judgment in favor of Elk Grove, finding, in part, that the trademark “Yellow Cab” had become generic through widespread use in the marketplace. Sacramento appealed.
