Facts
Mr. and Mrs. McKenzie (plaintiffs) lived next door to Mr. and Mrs. Yommer (defendants). The Yommers operated a gas station on their property. In January 1968, the Yommers installed a new gas-storage tank. Thereafter, the McKenzies learned that the installation had caused their water supply to be contaminated with gasoline. The McKenzies could not access safe water for cooking and bathing on their property until April 1968. Further, the McKenzies still did not have access to clean drinking water on their property at the time of trial in December 1968. The McKenzies brought suit against the Yommers for nuisance. The court ruled in favor of the McKenzies, and the Yommers appealed.
