Facts

Brian Yost (plaintiff) was a pledge at the Indiana Gamma Chapter of the Phi Kappa Psi Fraternity at Wabash College. Yost was subject to the mentorship of a “pledge father.” Yost sustained injuries in a hazing incident during fraternity pledging at the fraternity house. Yost sued Wabash College, the local chapter of the fraternity, and the national fraternity, Phi Kappa Psi Fraternity, Inc. (defendants) for his personal injuries. Both Wabash and the national fraternity prohibited hazing. The defendants each moved for summary judgment. The trial court granted the motions. The court of appeals affirmed. Yost appealed.
