Young v. Nissan
United States District Court for the Western District of Missouri
964 F. Supp. 1350 (1997)
- Written by Jody Stuart, JD
Facts
Marie Young (plaintiff) was involved in a car accident with Paul Knight, who ran a stop sign. Young settled her claim against Knight for $5,000 and signed a release. The release stated that Young released Knight, and any other person charged with liability, from any and all claims arising from the car accident. Young then brought an action against Nissan Motor Corporation (Nissan) (defendant), alleging that Young’s airbag deployed with excessive force. Nissan moved for summary judgment, alleging that the release signed by Young barred Young’s claim against Nissan.
