Facts
Vuitton et Fils S.A. (plaintiff) alleged that Young (defendant) violated Vuitton’s trademark. The court approved a settlement between the parties, which prohibited Young from any further trademark violations. Young violated the settlement agreement, and Vuitton filed a motion to hold Young in contempt. Vuitton’s attorneys were appointed special prosecutors of the contempt proceeding. A jury convicted Young of violating the settlement. The United States Court of Appeals for the Second Circuit affirmed. The United States Supreme Court granted certiorari.
