Facts
Yugraneft Corporation (Yugraneft) (plaintiff) was a Russian oil-field developer and operator. Yugraneft had a contract with Rexx Management Corporation (Rexx) (defendant), a Canadian materials supplier. After a dispute arose, Yugraneft initiated an arbitration proceeding in Russia. On September 6, 2002, the Russian arbitration tribunal ruled in favor of Yugraneft and ordered Rexx to pay monetary damages. Rexx did not make an application to set aside the Russian arbitration award. On January 27, 2006, Yugraneft commenced an action in Alberta, Canada, seeking to enforce the Russian arbitration award. The Alberta court dismissed the action as time barred. Yugraneft appealed.
