Facts
Michael Yurchak (plaintiff) had a basement that regularly leaked water. Yurchak hired Jack Boiman Construction Company and Jack Boiman (defendants) to waterproof his basement. The parties entered into a contract that guaranteed that the basement would be waterproof for 10 years. Yurchak paid Boiman $2400 in consideration. During the process of Boiman working on the basement, it rained, and water leaked into the basement. Boiman was unable to repair the basement from the damage. Yurchak brought suit against Boiman and the jury found for Yurchak. The jury determined that Yurchak did receive some small benefit from Boiman’s work and awarded Yurchak $2000. Boiman appealed.
