Facts
15-year-old Ronny Zamora (plaintiff) shot and killed his elderly neighbor. Zamora was subsequently convicted and imprisoned for the crime. Zamora and his parents (plaintiffs) then filed suit in federal district court against three broadcasting companies (the companies) (defendants), alleging that Zamora’s sociopathic tendencies stemmed from overexposure to violent television programs broadcasted by the companies throughout his childhood. The companies moved to dismiss the complaint, stating that it infringed on their First Amendment rights, that they owed no duty to Zamora, and that the complaint failed to set forth a basis supporting proximate cause. The district court granted the motion to dismiss with leave to amend. The plaintiffs elected not to amend.
