Facts
Cutter Dodge, Inc. (Cutter) (plaintiff) placed a newspaper advertisement showing a particular vehicle with a listed monthly purchase price and “0 cash down.” The fine print at the bottom of the ad stated, in part, that “prices incl. 400 Recent College Grad, 750-1000 Loyalty Rebate.” The Picos (plaintiffs) told a Cutter sales agent they wished to purchase the vehicle at the price listed in the ad and for “0 cash down,” but were told that the offer was only available to college graduates entitled to a loyalty rebate. The Picos were told they would have to make a down payment. The Picos sued Cutter. The circuit court held there was no contract between the parties, and the Picos appealed.
