Facts
Zepeda Rivas (plaintiff) was detained at a facility run by United States Immigration and Customs Enforcement (ICE) and filed a class-action lawsuit alleging that ICE had taken inadequate steps to protect detainees from an outbreak of coronavirus. The court issued a temporary restraining order (TRO) establishing a system for the court to consider whether certain detainees should be released to mitigate overcrowding and dangerous conditions in the facilities. Rivas then filed a motion for preliminary injunction, asking that the court order ICE to make a number of changes within the facilities, including having detainees sleep 10 feet apart and maintain a six-foot distance at all other times, arguing that ICE was violating detainees’ constitutional rights by requiring them to live in unsafe conditions. ICE responded that it had already taken several steps to increase safety since the court’s TRO, including having detainees sleep a few feet apart, shutting off about half the bathroom sinks to encourage social distancing, and permitting detainees to eat their meals at tables by themselves. ICE argued that further measures were unnecessary.
