Commercial-Activity Exception
Definition
Codified at 28 U.S.C. § 1605(a)(2), an exception to the Foreign Sovereign Immunities Act that confers jurisdiction on United States courts over claims based upon a foreign state’s commercial activity in the United States, acts in the United States in connection with the foreign state’s commercial activity elsewhere, or acts outside the United States relating to the foreign state’s commercial activity elsewhere that causes a direct effect in the United States.
