Expropriation Exception

Definition

Codified at 28 U.S.C. § 1605(a)(3), an exception to the Foreign Sovereign Immunities Act providing that a foreign state is not immune from the jurisdiction of United States courts if a plaintiff’s claim involves property taken in violation of international law and there is a commercial-activity nexus with the United States.
