Rule of civil procedure in federal courts allowing a plaintiff to voluntarily dismiss an action without prejudice, so long as the plaintiff has not voluntarily dismissed the same claim before, any time before the defendant has filed an answer or motion for summary judgment, or upon the stipulation of the parties.
