Undue Hardship

Definition

In employment law, an accommodation that imposes more than a de minimis cost on an employer. In bankruptcy law, a debtor may be entitled to a discharge of educational loans if not discharging the loans would cause the debtor an undue hardship, considering the totality of the circumstances including the debtor's past, present, and reasonably reliable future financial resources.
