Definition

A child’s civil cause of action that seeks tort recovery for being born with deformities. The gravamen of the claim is not that the doctor’s negligence caused the child’s deformities, instead it is that but for the doctor’s negligence, the child would not have been born to experience the pain and suffering attributable to the deformities.
