Facts
Four high school students (the students) (plaintiffs) were required by their teachers to submit academic papers to a website designed to check for possible plagiarism. The website, which was owned and operated by iParadigms, LLC (defendant), automatically checked submitted papers against existing papers and other publications contained in an internal database. Papers submitted to the website then became part of the database. The students brought suit against iParadigms in federal district court, arguing that the website’s retention of their papers violated their copyright interests. iParadigms asserted fair use as a defense and moved for summary judgment, which was granted. The students appealed to the United States Court of Appeals for the Fourth Circuit.
