Adams v. Woodlands of Nashua
New Hampshire Supreme Court
864 A.2d 322 (2005)
- Written by Rose VanHofwegen, JD
Facts
Woodlands of Nashua (defendant) rented an apartment to Mansfield Adams (plaintiff) and his two children in a 24-unit building. A roach problem persisted despite three pest-control treatments. The landlord blamed the infestation on another tenant, evicted that tenant, and changed pest-control companies. Adams sued, claiming the infestation violated his right to quiet enjoyment of his tenancy under New Hampshire landlord-tenant law. The court award Adams $26,000 in statutory damages, and the landlord appealed.
