Implied Warranty of Habitability
Definition
In the context of a residential lease, a promise that the landlord will keep the premises in good repair and generally in livable condition for the term of the lease. In the context of a residential sale of a new house, a promise by the seller that the house was built in a careful, workman-like manner and is fit for habitation.
