Facts
The Republic of Colombia (plaintiff) asked the Inter-American Court of Human Rights to issue an advisory opinion regarding what obligations countries have under the American Convention on Human Rights (the convention) concerning environmental issues. Specifically, Colombia asked about a country’s obligations when a country’s infrastructure projects could significantly impact the marine environment and the human habitat of coastal residents. Colombia also asked about how the convention should be interpreted in relation to other international environmental treaties that established nations’ obligations with respect to the prevention and mitigation of environmental damage. Because the court primarily addresses human-rights issues, the court considered Colombia’s request and issued an advisory opinion regarding countries’ environmental obligations related to the protection of human rights.
