Facts
Sondra Aflalo (plaintiff) and Henry Aflalo (defendant) are Orthodox Jews who were married in Israel in 1983. Pursuant to their religion, they entered into a “ketubah,” which is a marriage contract under which they agreed to abide by the laws of Moses and Israel. One such law is that the wife may not be released from the marriage unless the husband consents to a “get.” Mrs. Aflalo desired a divorce from Mr. Aflalo but he refused to consent to the get. He sought a hearing before the “Beth Din,” a rabbinical tribunal, to consider his attempts to reconcile with Mrs. Aflalo. Mr. Aflalo’s refusal to consent to the get was not an attempt to gain leverage in the couple’s divorce. He stated that if the Beth Din recommended that he provide the get, he would. Mrs. Aflalo filed a civil claim against Mr. Aflalo, asking the court to order Mr. Aflalo to consent to the get. The court considered her request.
